Terms of Service

1. Acceptance

By creating an account or using the TCM AI website or desktop application ("the Service"), you agree to these Terms. If you do not agree, do not use the Service.

2. Medical disclaimer

The Service provides AI-assisted analysis of symptoms, tongue, and pulse data based on classical and modern Traditional Chinese Medicine literature. It is a reference tool for licensed practitioners and students — NOT a substitute for clinical judgement, licensed medical diagnosis, or treatment. Output may be incorrect, incomplete, or outdated. You are solely responsible for any clinical decision, prescription, or advice you give to a patient. We disclaim all liability for outcomes arising from use of AI output.

3. Eligibility and accounts

You must be at least 18 years old and have authority to enter this agreement. You agree to keep your credentials confidential and are responsible for all activity under your account. Notify us immediately of any unauthorized use.

4. Billing and credits

The Service offers a free tier and paid subscription tiers billed monthly or annually in USD via Stripe. Credit costs per action: AI diagnosis, tongue image analysis, formula comparison, and insurance letter generation each cost 1 credit; report translation and refinement costs 0.5 credit; classical text search and knowledge browsing (herbs, formulas, acupoints) are free. Monthly plan credits expire at the end of each billing period and do not roll over; purchased credit top-ups carry over. Subscriptions renew automatically until cancelled. Cancellations take effect at the end of the current billing period; we do not prorate partial-month refunds. Pricing may change with 30 days' notice.

5. Refund policy

Refunds within 7 days of initial subscription are available on request if the Service has not been substantially used. After 7 days refunds are at our discretion and only for verified billing errors or service outages exceeding 24 continuous hours.

6. Acceptable use

You may not: (a) use the Service to provide direct diagnosis to patients in a jurisdiction where you are not licensed to practise; (b) scrape, resell, or redistribute AI output or knowledge-base content as your own service; (c) attempt to reverse engineer, circumvent rate limits, or probe security of the Service; (d) upload content that infringes intellectual property, violates law, or contains patient personally-identifiable information (the cloud API rejects identifiers by design).

7. Your content and data

You retain ownership of symptoms, observations, and consultation notes you submit. You grant us a non-exclusive licence to process that data to operate the Service. Patient personally-identifiable data is stored locally in the desktop app and is not uploaded to our servers. See Privacy Policy for details.

8. Intellectual property

The Service, including its software, knowledge-base excerpts, UI, and branding, is owned by us or our licensors. The 689-text classical knowledge corpus is reproduced under fair-use and public-domain provisions for reference and search; you may not extract or redistribute the corpus in bulk.

9. Service availability

We target 99% monthly uptime but do not guarantee uninterrupted service. AI responses depend on third-party providers (Google Gemini) and may degrade or fail. Scheduled maintenance will be announced where feasible.

10. Termination

You may cancel at any time from your account page. We may suspend or terminate accounts that violate these Terms, engage in fraud, or pose a security risk, with or without notice. Upon termination your access ends and your data is purged per the Privacy Policy.

11. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising from your use of the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or punitive damages, including lost profits or clinical outcomes.

12. Changes

We may update these Terms. Material changes will be announced by email and on the website at least 14 days before taking effect. Continued use after that date constitutes acceptance.

13. Governing law

These Terms are governed by the laws of [jurisdiction]. Disputes will be resolved in the courts of that jurisdiction unless a binding arbitration clause applies in your locale.
